The underlying claim in this action arises from an injury suffered by plaintiff-appellant Sylvio J. Pitasi ("Pitasi") in a skiing accident at Stratton Mountain, a ski resort owned and operated by defendant-appellee The Stratton Mountain Corporation ("Stratton"). Pitasi's complaint alleged that his injuries, which left him paralyzed from the neck down, resulted from Stratton's negligence in failing to rope off the side entrances to a closed...
