Defendant was charged by bill of indictment on January 15, 1976 with first degree murder, a violation of R.S. 14:30. Defendant was tried by a twelve member jury on April 6, 1976 and found guilty as charged. The court granted defendant a new trial on May 3, 1976. After a second trial on May 26, 27, 1976, the twelve member jury found defendant guilty of second degree murder. On June 2, 1976 defendant was sentenced...
