This is an appeal and cross-appeal from an order on motion for postconviction relief from a sentence of death. We have jurisdiction under article V, section 3(b)(1) of the Florida Constitution.

Mitchell was convicted of the first-degree murder of Walter Shonyo. The jury recommended the death penalty, and the trial court imposed a sentence of death. The judgment and sentence were affirmed on appeal. In our opinion, we described the circumstances...
