On October 13, 1988, while operating a table saw during his employment with Robinson Foundry in Alexander City, Alabama, James Hutchins suffered an injury, an amputation of his left thumb. On December 19, 1989, he sued JET Equipment & Tools, Inc., the supplier of the table saw, and also 27 fictitiously named parties.
