OPINION

THOMAS, Justice.

This is a mandamus action against the Honorable Richard A. Bosworth arising out of a writ of habeas corpus proceeding filed under section 14.10 of the Texas Family Code. We conclude that Brenda Lewelling (Mother) is entitled to have possession of her minor son, J.J. Lewelling. Therefore, we conditionally grant the writ.
