Kenneth G. Hicks lost his job in 1982 when Brown Group, Inc., reduced the supervisory staff at its Benton, Missouri, terminal. Hicks, a white male then 51 years old, sued and a jury found that he was terminated because of his race in willful violation of 42 U.S.C. § 1981. He was awarded $1.00 in actual damages, $10,000 in punitive damages, and his costs and attorneys' fees. Brown Group appealed and a panel of this court affirmed...
