This appeal arose from a suit brought by Evelyn Fox against the City of New Orleans. The plaintiffs in this case were Mrs. Fox's children, since both she and her husband died before the suit came to trial. The trial court found the City of New Orleans liable for Mrs. Fox's injuries, caused when she tripped over broken pavement on a public sidewalk, in the amount of $43,822.
