This case is before us on remand from the United States Supreme Court. See United States v. Gambino, ___ U.S. ___, 112 S.Ct. 1657, 118 L.Ed.2d 381 (1992). It originally came to us on appeal from a judgment of the United States District Court for the Southern District of New York (Leisure, J.), which denied defendants' motions to dismiss an indictment for a successive conspiracy prosecution on double jeopardy grounds.
