ERVIN, Chief Judge:

Joel Davis was convicted in the District of Maryland of mail fraud and interstate travel in aid of racketeering. Subsequently, Davis pled guilty on a severed count of the same indictment, which charged conspiracy to murder an agent of the Internal Revenue Service.
