WEBB, Justice.

The defendant first assigns error to the denial of a motion to suppress an inculpatory statement he made while he was in custody on the ground that he did not waive his right to counsel before making the statement. Edwards v. Arizona, 451 U.S. 477, 101 S.Ct. 1880, 68 L.Ed.2d 378 (1981). A hearing on this motion was held prior to the trial of the case.
