This appeal arises out of a 1989 accident on Central Avenue in the Town of Colonie, Albany County, when, during what developed into a physical altercation in a vehicle operated by defendant between him and the front seat passenger, Raymond Jewett, the vehicle veered into the oncoming lane and struck an automobile driven by Susan Esposito.
