Defendant, Ross Hunter Shepherd, was convicted of first degree murder by a jury in district court and sentenced to life in prison. On direct appeal to this court, he argues: 1) that the evidence was insufficient to support the verdict of first degree premeditated murder and 2) that the trial court committed reversible error by refusing to instruct the jury on the lesser included offense of second degree felony murder.
