This is the third appeal of a personal injury case arising out of a motor vehicle accident in Conrad, Montana, on January 4, 1985. The first trial resulted in a jury verdict on March 21, 1988, finding neither Thompson nor Tigart to be negligent. The District Court granted a new trial for irregularities in the proceedings.
