On May 31, 1990, the Honorable John D. Kuhn dismissed preliminary objections to that part of plaintiffs' complaint based on The Unfair Trade Practices and Consumer Protection Law, 73 P.S. §201-1. In his opinion Judge Kuhn said, "Sellers argue that they are not engaged in trade or commerce which would bring them within the protection of the act."*
