This is an appeal by plaintiff-appellant, N & D, Inc., et al. (hereinafter "N & D"), from a summary judgment granted by the Common Pleas Court of Allen County in favor of defendant-appellee, Charles W. Harrod, Sheriff of Allen County, and third-party defendant-appellee, Joe Guagenti.
