The above captioned plaintiffs ("appellants") appeal from the summary judgment entered in the Perry County Court of Common Pleas dismissing appellants' complaint and entering judgment in favor of defendant, Randy Shipley ("appellee"), after finding no genuine issue as to any material fact existed and that appellee was thereby entitled to judgment as a matter of law.
