On October 23, 1987, a federal grand jury returned a two-count indictment, charging appellants Rene Perez and Wilfredo Ventura with possession with intent to distribute marijuana, in violation of 21 U.S.C. § 841(a) and 18 U.S.C. § 2 (Count I), and conspiracy to possess with intent to distribute marijuana, in violation of 21 U.S.C. § 841(a)(1) and § 846 (Count II). Following a jury trial, Perez and Ventura were found guilty...
