Sherrill and Dora Duncan instituted this action against the Farm Credit Bank of St. Louis (the Bank), seeking to enforce a provision of the Agricultural Credit Act of 1987 that grants a right of first refusal to repurchase foreclosed property. The district court dismissed the suit. The Duncans did not seek a stay of judgment, and the Bank sold the disputed property to a third party. The Duncans appeal the dismissal of their suit.
