Granted and remanded. Trial court is ordered to conduct an evidentiary hearing, after first appointing counsel and requiring the state to file an answer on the merits. La.C.Cr.P. arts. 927,930.7. Otherwise denied.

MARCUS, J., concurs, however in the event it is found that the guilty pleas to both offenses violated double jeopardy, see State ex rel. Butler, 558 So.2d 552
