On December 16, 1971 plaintiff, four-year-old Marlana Conti, was brought to defendant Albany Medical Center Hospital (hereinafter the hospital) with a history of vomiting and weight loss. After diagnostic testing confirmed the presence of a brain tumor, surgery was performed by Dr. Richard Lende, a private physician, and most of the tumor was removed.
