On November 15, 1989, in Montgomery County, Ohio, the injured party, James R. Webb, suffered personal injury as a result of an assault by Shawn Goubeaux. The applicant, Marilyn Keaton, is James's mother.

The assault was reported to the Dayton Police Department within seventy-two hours after the occurrence.

The assailant, Shawn Goubeaux, was adjudicated as a delinquent on a charge of rape.
