The within matter was tried without a jury before the undersigned on January 4 and 5, 1990 for attorney fees claimed under the No-fault Motor Vehicle Insurance Act, 40 Pa.C.S. 1009.107(3), since repealed,* on the theory that defendant State Farm Mutual Automobile Insurance Company had refused to pay a "significant part" of certain benefits under plaintiff's policy "without reasonable foundation."
