Defendants have filed a notice of appeal, claiming the right to have my discovery order reviewed by the Superior Court. The order appealed from imposes sanctions of a preclusive nature, and is designed to punish defendants for their discovery misconduct.1 I'm hoping, of course, that "gagging" defendants will enhance plaintiff's chances of prevailing when (and if) her claim is called for trial.
