Plaintiff, Luis A. Penaranda, brings this case pursuant to the Court's civil rights jurisdiction under 28 U.S.C. § 1343. Plaintiff was formally the licensed operator of a day care center in Waynesboro, Georgia. Within months of the opening of plaintiff's day care center, a parent reported to local authorities that plaintiff had sexually molested her child who was enrolled at plaintiff's day care center.
