Dennis Freligh does not want to testify before the Grand Jury. The government wants his testimony. This is the second appeal stemming from this test of wills. On January 30, 1990, a panel of this court vacated the district court's original order of civil contempt and remanded the cause for a hearing to determine the nature and extent of Freligh's self-professed fear of testifying.
