This is a diversity action arising out of an investigation and arrest, followed by a criminal prosecution, disciplinary proceeding and subsequent dismissal of plaintiff, Frank Hannah ("Hannah"), an employee of defendant Metro-North Commuter Railroad ("Metro-North").
