This case arose out of the commodity futures trading tragedy of Dr. and Mildred Puckett. The trial court granted summary judgment in favor of Rufenacht, Bromagen & Hertz, Inc. (RB & H), the broker, on all counts below. We affirm the summary judgment dismissing the Pucketts' claims that RB & H committed common law fraud or violated § 4b of the Commodities Exchange Act (CEA), 7 U.S.C. § 6b.
