Ernest Henry Matousek ("Matousek") appeals his conviction on two counts of bank fraud under 18 U.S.C. § 1344(a)(1). The District Court for the District of Minnesota1, sitting without a jury, sentenced Matousek to five years imprisonment on each count, with the sentences to run concurrently.

On appeal, Matousek contends that his conduct is not criminal within the reach of the federal bank fraud...
