Appellant pleaded guilty to armed bank robbery, 18 U.S.C. § 2113(a) and (d) and use of a firearm to commit the robbery, 18 U.S.C. § 924(c). He was sentenced to fifteen years imprisonment for the armed bank robbery and a consecutive five years of imprisonment for the use of the firearm. He filed a motion pursuant to 28 U.S.C. § 2255 claiming that the consecutive five-year sentence constituted double jeopardy. His motion was denied. He unsuccessfully...
