On February 27, 1987 Jonathan T. Johnson and Terry Johnson, appellants herein, were each charged with simple burglary of an inhabited dwelling, a violation of R.S. 14:62.2.

Terry Johnson was found guilty as charged by a jury on October 29, 1987. He was sentenced on November 5, 1987 to ten years at hard labor with credit for time served, the first year of that sentence to be served without the benefit...
