PAUL PRESSLER, Justice.

Appellee sued appellant on a promissory note. We affirm.

In 1977 Zieben entered into an earnest money contract ("Agreement") to buy 12.6121 acres in Harris County from Shadow Corporation, which was owned by James B. DeGeorge.
