Appellant was charged by information in the county criminal court at law for unlawfully carrying a weapon. He filed a writ of habeas corpus in the district court claiming that the statute under which he is charged, Tex.Penal Code Ann. § 46.02 (Vernon 1974), is unconstitutional.
