This is an appeal from a summary judgment entered in the Jefferson Circuit Court.

Marcus L. Ray was shot while working at a restaurant owned by appellee, Hardee's Food Systems, Inc., d/b/a Hardee's (hereinafter referred to as "Hardee's".)
