GOLDBERG, Circuit Judge:

Pralhad S. Jhaver ("Jhaver"), the plaintiff, sued Zapata Off-Shore Company ("Zapata"), the defendant, for commissions owed. The district court granted Jhaver summary judgment. We reverse and remand.
