On May 24, 1989, appellant was tried and found guilty of unlawful possession of a controlled substance, in violation of § 13A-12-212, Code of Alabama 1975. On August 9, 1989, he was sentenced as a habitual offender to serve 15 years in prison. He was further ordered to pay $25 to the Crime Victims' Compensation Fund and to pay court costs.
