This action is brought under the Federal Employers' Liability Act (FELA), Title 45 U.S.C. §§ 51-60 (1982).

Tynes sued his employer, Alabama Great Southern Railroad Co. (AGS), claiming several negligent acts or omissions on the part of AGS which resulted in injuries to him.
