This is a worker's compensation case. Plaintiff, a truck driver, was injured on the job when a tire he was changing exploded. He first filed his claim for benefits with the Office of Worker's Compensation of the State Department of Labor which recommended that benefits be paid for temporary total disability together with penalties and attorney fees.
