SHEPARD, Justice.

Defendant Richard Badgley was in effect charged with one count of possession of a controlled substance. Badgley was bound over to district court for trial and pled guilty. At the time for sentencing, the district court sentenced Badgley to ninety days in jail with credit for four days served with the remainder suspended, and a fine of $2,500.00 plus attorney fees.
