With apologies to the poet,1 this case is "here as on a darkling plain swept with confused alarms of struggle and flight." But the darkness is more apparent than real: by ignoring the grating roar of partisan rhetoric and concentrating instead on what Congress purposed and what the Court has taught, ample illumination is to be found.
