GRANT, Justice.

Johnson was convicted of murder in a trial by jury. The jury also made an affirmative finding that Johnson used a deadly weapon and set his punishment at forty years' confinement with a $10,000 fine.

Johnson brings four points of error in which he contends (1) that the jury charge on punishment was fundamentally defective because without prior notice, a charge on his use of a deadly weapon was submitted, (2) that the evidence was legally insufficient...
