Defendant, Alvin L. Welch, was indicted by grand jury with second degree murder (a violation of LSA-R.S. 14:30.1). Defendant's first trial ended in a hung jury. After a second trial by jury, defendant was found guilty of manslaughter and sentenced to serve eighteen years at hard labor. Defendant's only assignment of error on appeal is that the trial court erred in imposing an unconstitutionally excessive...
