Plaintiff brings suit pursuant to 42 U.S. C. § 1981 and § 296 of New York's Human Rights Law for alleged discrimination based on race and national origin. Plaintiff claims defendant has denied her a promotion, despite her qualifications, even though the person she replaced, who was white, performed the same responsibilities with a higher title and more pay.
