On November 6, 1981, the defendant, Barry Chavis, was charged by grand jury indictment with forcible rape, a violation of La.R.S. 14:42.1. On November 18, 1987, defendant was convicted of the charged offense by a twelve member jury. Defendant was subsequently sentenced on March 8, 1988, to serve 40 years at hard labor with the first two to be served without benefit of probation, parole or suspension of sentence.
