Appellant, Joseph Donald Malmay, was charged by bill of information with operating a vehicle while intoxicated, fourth offense, in violation of La.R.S. 14:98. The offense occurred on November 25, 1986. A plea bargain was reached by which appellant would plead guilty to the November 1986 charge with the understanding that the State would not prosecute a similar charge arising from a driving incident on February 5, 1988.
