BUCK v. GREEN

No. 88-8522.

874 F.2d 1578 (1989)

Ronnie BUCK, Petitioner-Appellee, v. Calvin GREEN, Warden, Respondent-Appellant.

United States Court of Appeals, Eleventh Circuit.

June 13, 1989.

Attorney(s) appearing for the Case

William B. Hill, Jr., Paula K. Smith, Asst. Attys. Gen., Atlanta, Ga., for respondent-appellant.

Alice Stewart, Atlanta, Ga., for petitioner-appellee.

Before HILL and EDMONDSON, Circuit Judges, and ATKINS, Senior District Judge.

EDMONDSON, Circuit Judge:

This habeas corpus appeal involves 28 U.S.C. § 2254(d)(1) and the presumptive correctness of certain state court determinations. The district court granted habeas corpus relief to Ronnie Buck on the ground that blacks were systematically excluded from the grand and traverse jury rolls from which the jury that convicted Buck was selected. We vacate the district court's judgment and remand with directions.
