Petitioner-appellant James Lowery was convicted on eight counts of first degree forgery in a Georgia state court in 1981. While on parole for that sentence in 1985, he was arrested in Wisconsin and subsequently convicted in that state for first degree sexual assault, armed robbery, and false imprisonment.1 Lowery was sentenced to 65 years under Wisconsin's Habitual Offender Statute (Wis.Stat. 939.62 & 939.63 ...
