PER CURIAM:

On June 26, 1973, Robert Emerson Marble executed his Last Will and Testament. Pursuant to that Will, two trusts were created upon his death, one for each of his two surviving children, Julia Marble Fishbacker and Robert R. Marble. Robert's trust provided that Robert was entitled to the annual net income of the trust plus a discretionary noncumulative amount of $5,000.00 or 5% of the trust's value at the end of each calendar year.
