OPINION
COATS, Judge.
Magistrate George Peck convicted Kevin W. Kinnish of misconduct involving weapons in the second degree (possession of a firearm while intoxicated). AS 11.61.210(a)(1). On appeal, Kinnish challenges his conviction on the ground that his possession of a pellet pistol did not constitute a violation of the statute because a pellet pistol is not a firearm as the term is used in the statute.
