I.Q. Kirby was indicted on three counts of second degree kidnapping in violation of § 13A-6-44, Code of Alabama 1975, and two counts of first degree robbery in violation of § 13A-8-41, Code of Alabama 1975. The appellant was convicted of one count of first degree robbery and three counts of second degree kidnapping, all as charged in the indictment. He was sentenced to life in prison as a habitual felony...
