Tyronne Lindsey was indicted by the Jefferson Parish Grand Jury on February 15, 1980, charged with the first degree murder of one Earline B. Kidner, a violation of La.R.S. 14:30. After a trial by jury, defendant was found guilty as charged. The same jury unanimously recommended the death sentence. Defendant appealed his conviction and sentence to this court. State v.
